Only You Terms of Service

These Terms of Service (“Terms”) govern the Only You mobile application and related services provided by Nawaplay (“Nawaplay,” “we,” “us,” or “our”). Please review these Terms and our Privacy Policy before creating an account or using the Service.
1. Purpose
These Terms set out the rights, responsibilities, and conditions that apply between you and Nawaplay when you use the Service.
2. Definitions
- Service means the Only You mobile application, related web pages, customer support, account synchronization, and associated features we provide.
- User means a person who accepts these Terms and uses the Service.
- Chosen Person means the one person a User selects through the device’s system contact picker.
- Feeling Signal means a moment a User records in the Service when the Chosen Person comes to mind.
- Journal Entry means a date, text, photo, video, or related information a User saves in a private timeline or collection.
- Mutual Choice means the state in which two Users have chosen each other and all conditions for mutual disclosure have been met.
- Subscription means paid access purchased through the App Store or Google Play.
3. Acceptance and changes
- These Terms become binding when they are displayed in the Service or on our website and you accept them.
- We may amend these Terms to comply with law or to reflect reasonable changes to the Service. We will ordinarily provide at least seven days’ notice and at least 30 days’ notice for a material change that is unfavorable to Users.
- We will obtain separate consent where required by law. If you do not agree to revised Terms, you may stop using the Service and delete your account before they take effect.
- Localized versions are provided for convenience and are intended to have the same meaning. If versions conflict, the Korean version is the reference version, but it does not override mandatory rights under the law where you live.
4. Eligibility and account creation
- You must generally be at least 17 years old to use the Service. A higher age applies where required by local law or marketplace rules.
- Your agreement with us begins when you accept these Terms and the Privacy Policy, complete registration, and we approve access.
- We may refuse or later restrict registration where a person is underage, provides false information, uses another person’s identity, attempts to evade a prior serious restriction, or presents a material technical or security risk.
- You may use only an email address, phone number, and sign-in account you are authorized to use.
5. How the Service works
- The Service may provide selection of one person, Feeling Signals and Journal Entries, a private timeline, Mutual Choice checks, a shared relationship space and messaging after disclosure, and subscription-based storage features.
- We do not send an invitation or notification revealing your selection or signals to a Chosen Person who has not joined the Service.
- Mutual disclosure occurs when both Users have selected each other and each has completed all of the following: 48 hours after selection, Feeling Signals on at least three different days, and advance confirmation that disclosure may occur once the conditions are met. We may recheck these conditions before disclosure to prevent error or misuse.
- A connection candidate may remain for 90 days after the most recent signal and may renew with a new signal. It may end if a User changes the Chosen Person, the candidate expires, or the phone-number owner submits a valid opt-out.
- The Service does not guarantee that another person will join, choose or respond to you, that a relationship will begin or continue, or that a match will occur. Before Mutual Choice, we do not reveal whether the other person has joined, how many Users or signals exist, anyone’s identity, or exact signal times.
- You must respect another person’s choices and boundaries. You may not use information learned through the Service for unwanted contact, surveillance, harassment, or harm.
6. Account security
- You are responsible for reasonably safeguarding your account and authentication methods. You may not sell, lend, transfer, or share your account.
- If you suspect unauthorized use or a security breach, promptly secure your sign-in method and contact kenny@nawaplay.com.
- We may require additional verification, such as SMS multi-factor authentication, for phone-number changes, account recovery, or sensitive account actions.
- You may be responsible for loss caused by your intentional or negligent disclosure of authentication credentials, except to the extent the loss is attributable to us.
7. Your content
- You or the applicable rights holder retain ownership of Journal Entries and other content you create or upload.
- You grant us a non-exclusive, royalty-free license to store, encrypt, compress, transform, back up, synchronize, and display your content to you or, after Mutual Choice, to the permitted person, only as needed to operate the Service. This license ends when the relevant content is deleted, except for limited backup or legal-retention periods.
- We do not use Journal Entries as advertising material or sell them to third parties.
- You must have the rights necessary to upload content. You may not upload unlawful or harmful material or content that violates another person’s privacy, publicity, copyright, or other rights.
- Before uploading a photo or video, you should check that it does not expose sensitive information about another person without permission.
8. Subscriptions, billing, cancellation, and refunds
- The price, billing period, free trial, features, and storage allowance of a Subscription are shown before purchase. Billing and renewal are processed through the App Store or Google Play account you select.
- An automatically renewing Subscription may renew for the same period unless canceled through your marketplace account before the renewal date. After cancellation, paid features generally remain available through the period already purchased.
- Refunds, statutory cancellation rights, payment reversals, and billing errors are ordinarily handled through the applicable marketplace and under applicable law. Neither marketplace policies nor these Terms limit non-waivable refund or cancellation rights.
- A free trial may be limited by User or marketplace account and may convert to a paid Subscription at the end of the trial if disclosed on the purchase screen.
- Deleting your account and canceling your Subscription are separate actions. Deleting an account may not stop marketplace billing, so you must also cancel the Subscription in the marketplace.
- If you cancel or downgrade and exceed the new storage allowance, we may preserve existing entries rather than immediately deleting them while restricting new uploads or some features until usage is within the allowance.
9. Prohibited conduct
You may not:
- impersonate another person or misuse another person’s account, phone number, identity, or authentication method;
- engage in unwanted contact, stalking, threats, harassment, discrimination, sexual exploitation, or conduct that endangers another person;
- store or transmit unlawful, obscene, violent, malicious, infringing, or spam content;
- bypass authentication, age restrictions, storage limits, access controls, or Mutual Choice conditions;
- use automation for abusive bulk requests, reverse engineer the Service except where law permits, exploit vulnerabilities, interfere with the Service, or impose an unreasonable load;
- disclose, sell, or misuse information or messages learned through Mutual Choice without the other person’s permission; or
- violate applicable law, these Terms, or reasonable operational and safety rules we publish.
10. Restrictions and enforcement
- If we reasonably confirm prohibited conduct, a legal violation, harm to another person’s rights or safety, or a concrete security risk, we may block content, restrict features, suspend an account, or terminate access.
- Except where urgent safety or security measures are required, we will ordinarily explain the reason, provide an appeal method, and allow a reasonable opportunity to correct the issue where appropriate.
- You may appeal a decision by contacting kenny@nawaplay.com. We will review relevant information and notify you whether the measure is maintained, modified, or removed.
11. Changes, availability, and discontinuation
- We may reasonably change parts of the Service for quality, security, legal, marketplace-policy, or technical reasons. We will provide reasonable advance notice of changes that materially affect User rights.
- The Service may be temporarily unavailable for maintenance, communications failures, events beyond reasonable control, third-party authentication, cloud or marketplace outages, or urgent security work. Where practicable, we will provide notice and work to restore the Service promptly.
- If we permanently discontinue the Service, we will ordinarily provide at least 30 days’ notice and explain the treatment of remaining paid access and User data as required by law.
12. Termination and deletion
- You may terminate this agreement at any time by requesting account deletion in app settings. You may also contact us for assistance.
- When deletion is complete, we remove the account, Feeling Signals, Journal Entries, relationship data, and messages from active systems. Legally required records and disaster-recovery backups are separated or rotated out as explained in the Privacy Policy.
- Deletion of individual entries, ending a relationship, changing a Chosen Person, and a phone-number opt-out are handled under the retention and deletion rules in the Privacy Policy.
- You should save any records you need before deletion. Completed deletion may be irreversible.
13. Intellectual property
- The Service software, design, trademarks, logos, copy, and content created by us belong to Nawaplay or the applicable rights holder.
- We grant you a limited, personal, non-commercial, non-transferable, and revocable right to use the Service in accordance with these Terms.
- Except where permitted by law or our written permission, you may not copy, distribute, sell, rent, modify, or create derivative works from any part of the Service.
14. Third-party services and marketplaces
- The Service may connect to third-party services such as Apple, Google, and Firebase. Their terms and policies may also apply to your use of their services.
- Apple and Google are not the operator of the Service or a party to this agreement and have no obligation to operate or support the Service except as required by law or their applicable platform terms.
- A third-party outage or policy change may limit a feature. We will use reasonable efforts to restore the feature or provide an appropriate alternative.
15. Disclaimers and liability
- We use reasonable care and skill in providing the Service, but do not promise that another person will join, select or respond to you, that a relationship will result, that an entry will have any particular emotional effect, or that the Service will always be uninterrupted or error-free.
- Contacts, meetings, relationships, and disputes between Users remain the responsibility of the people involved. We will nevertheless respond reasonably to safety reports and valid legal requests.
- We are not responsible for loss caused by circumstances not attributable to us, your violation of these Terms, or an unforeseeable third-party outage.
- Where loss results from our ordinary negligence, our liability may be limited to direct loss that was reasonably foreseeable. This limitation does not apply to our willful misconduct or gross negligence, death or personal injury, breach of privacy or data-protection duties, or any liability that applicable law does not allow us to limit.
- Nothing in these Terms excludes or restricts a statutory warranty, refund, cancellation right, or other mandatory consumer protection available under applicable law.
16. Responsibility for breach
If either you or Nawaplay violates these Terms or applicable law through a matter attributable to that party and causes loss to the other, responsibility is determined according to the degree of fault and applicable law.
17. Governing law and disputes
- These Terms are governed by the laws of the Republic of Korea. Mandatory consumer protections in the place where you live continue to apply where legally required.
- If a dispute arises, you and Nawaplay should first attempt to resolve it in good faith. If it cannot be resolved, either party may bring a claim in a court with jurisdiction under applicable procedural law.
- You may also use consumer mediation or another statutory dispute-resolution process available where you live. These Terms do not require individual arbitration or waive a right to participate in a lawful collective proceeding.
